Terms of Service

Effective from 17 October 2026

This is an English translation provided for convenience. The Polish version is legally binding: Regulamin (Polish version).

§ 1. General provisions

  1. These Terms of Service set out the rules for using the Trackerosa service available at https://trackerosa.com/ (the “Service”) and constitute the terms and conditions referred to in Article 8 of the Polish Act on Providing Services by Electronic Means.
  2. The service provider is ROSPRO Paweł Rosa, Pątnówek 23B, 59-222 Miłkowice, Tax ID (NIP) 6912540404, Business ID (REGON) 381996702 (the “Service Provider”). Contact: contact@trackerosa.com.
  3. Definitions: User — a person using the Service through an Account; Account — a set of the User's data and settings protected by an email address and password; User Data — content entered by the User (clients, projects, tasks, time entries, report links, ClickUp connections); Team — a group of Users sharing clients, projects and time entries, managed by the Team Owner.

§ 2. Services

  1. The Service makes it possible to record working time, manage clients, projects, tasks and tags, set rates and budgets, create reports and export them (CSV, Excel, PDF), share reports with clients via a link, work in teams and browse tasks from ClickUp.
  2. The service agreement is concluded upon activation of the Account and is entered into for an indefinite period.

§ 3. Technical requirements

Using the Service requires: a device with internet access, an up-to-date browser (Chrome, Firefox, Safari or Edge) with JavaScript and cookies enabled, and an active email address.

§ 4. Account

  1. An Account may be created by an adult (a person who is at least 18 years old) by providing an email address and password and accepting the Terms of Service and the Privacy Policy.
  2. The Account is activated by clicking the link sent to the email address provided. The link is valid for 3 days; an Account not activated within 7 days is deleted.
  3. The User keeps their password confidential and is responsible for actions performed using their Account.
  4. The demo account is shared by all visitors — real data should not be entered into it; its content may be changed or reset at any time.

§ 5. Rules of use

It is prohibited to enter unlawful content, to attempt to gain access to other people's Accounts or data, to take actions that disrupt the operation of the Service (including automatically sending large numbers of requests) and to use the Service contrary to its intended purpose.

§ 6. ClickUp integration and client links

  1. The User creates a ClickUp connection with their own API token and is responsible for the scope of permissions granted by it. The availability of data from ClickUp depends on the operation of ClickUp services.
  2. A report link works without signing in — anyone who knows it can see the data selected by the User. The User decides who receives the link, sets its scope and validity period, and may delete it at any time.

§ 6a. Teams

  1. Each Account has its own Team, of which the User is the Owner. The Owner or a partner may invite other people to the Team by providing their email address and role: partner (access to all Team data, including other people's entries and amounts, and management of clients, projects and people) or employee (recording time for the Team's clients and projects, access only to their own entries, without amounts).
  2. The person sending an invitation is responsible for having a basis to provide the invited person's email address. An invitation expires after 7 days.
  3. Team data (clients, projects, tasks, tags, time entries) belongs to the Team; with respect to personal data contained in Team data, the controller is the Team Owner (§ 9). Each member edits only their own time entries.
  4. A Team member may leave the Team at any time, and the Owner or a partner may remove a person from it; that person's time entries remain in the Team. After an Account is deleted, its entries in other people's Teams remain there without author details, and the Teams of which its holder was the Owner are deleted together with their data.

§ 7. Fees

  1. Use of the Service in the basic plan (“Core”) is free of charge. The basic plan includes all features described in § 2.
  2. The Service Provider may introduce paid add-on features in the future. Their scope, prices and payment terms will be announced before they are introduced and described in the Terms of Service; using them will be optional and will require a separate order placed by the User.
  3. Introducing fees for features that have so far been free of charge requires an amendment to the Terms of Service, of which the Service Provider notifies Users by email at least 30 days before it takes effect; a User who does not accept the amendment may delete their Account before that date.
  4. The Service Provider will issue invoices for paid features.

§ 8. Availability and liability

  1. The Service Provider makes every effort to ensure that the Service operates without interruption, subject to technical breaks, which it announces in advance whenever possible.
  2. Users are advised to periodically download reports or Account data (Settings → Account) as their own copy.
  3. In relation to Users who are entrepreneurs (excluding entrepreneurs with consumer rights), the liability of the Service Provider is excluded for free services and, for paid add-on features, limited to the amount of fees paid for the last 12 months; this exclusion and limitation do not apply to damage caused intentionally.

§ 9. Entrustment of personal data processing

  1. With respect to personal data contained in User Data (e.g. data of clients and their employees), the User is the controller and the Service Provider is the processor; this section constitutes a data processing agreement within the meaning of Art. 28 GDPR.
  2. The Service Provider processes such data solely for the purpose and to the extent necessary to provide the services, on the documented instructions of the User, which consist in using the features of the Service, for the term of the agreement.
  3. The Service Provider ensures the confidentiality of the data, applies the security measures referred to in Art. 32 GDPR, assists the User in responding to requests from data subjects exercising their rights, and notifies the User of a personal data breach without undue delay, no later than 48 hours after becoming aware of it.
  4. The User consents to the use of OVHcloud services (server, database, email) as a sub-processor; the Service Provider gives advance notice of any intended change of sub-processors, and the User may object by deleting their Account. The User enables the ClickUp integration on their own instruction.
  5. After the Account is deleted, the Service Provider deletes the User Data, subject to backups overwritten in the regular cycle, and makes available to the User the information necessary to demonstrate compliance with the obligations under Art. 28 GDPR.

§ 10. Complaints

Complaints may be submitted to contact@trackerosa.com, with a description of the problem. The Service Provider responds within 14 days of receiving the complaint.

§ 11. Termination of the agreement

  1. The User may terminate the agreement at any time by deleting their Account in Settings → Account; the User Data is then deleted immediately.
  2. The Service Provider may block an Account or terminate the agreement in the event of a gross breach of the Terms of Service, after an unsuccessful request to cease the breach, and for other important reasons — with 30 days' notice sent by email.

§ 12. Consumers

  1. A consumer and an entrepreneur with consumer rights (a natural person concluding an agreement directly related to their business activity, where the agreement is not of a professional nature for them) may withdraw from the agreement within 14 days of its conclusion without giving any reason, by sending a statement to contact@trackerosa.com.
  2. If, at the User's express request, the provision of a paid add-on feature began before the withdrawal period expired, a User who withdraws from the agreement pays for the services provided up to the moment of withdrawal.
  3. A consumer may use out-of-court dispute resolution methods, e.g. the assistance of a municipal or district consumer ombudsman.

§ 13. Amendments to the Terms of Service and final provisions

  1. The Service Provider notifies Users of amendments to the Terms of Service by email at least 14 days before they take effect. A User who does not accept the amendments may delete their Account before that date.
  2. Matters not regulated herein are governed by Polish law, in particular the Civil Code, the Act on Providing Services by Electronic Means, the Consumer Rights Act and the GDPR.
  3. Disputes with Users who are entrepreneurs (excluding entrepreneurs with consumer rights) are resolved by the court having jurisdiction over the Service Provider's registered office.
  4. These Terms of Service are effective from 17 October 2026. Privacy Policy: https://trackerosa.com/en/privacy.
